These Terms and Conditions (“Terms”) govern the rental of the self-catering holiday cottage (“The Property”) operated by Sarah Haynes Business T/A Bell Cottage Yorkshire (“We”, “Us”, “Our”). By making a booking, you (“The Guest”, “You”) agree to be bound by these Terms. This agreement constitutes a licence to occupy the Property for holiday purposes only, as defined under the Housing Act 1988.
You must be 18 years of age or over when the booking is made. We reserve the right to refuse the booking for any lawful reason.
1. DEFINITIONS
1.1 “The Property” means the self-catering holiday cottage located at:

1.2 “The Guest” means the person making the booking and all persons in their party.
1.3 “Booking Confirmation” means our written confirmation of your reservation.
1.4 “Check-in Date” means the first day of your stay as specified in the Booking Confirmation.
1.5 “Check-out Date” means the last day of your stay as specified in the Booking Confirmation.
1.6 “Security Deposit” means the refundable deposit of £200 required for all bookings.
1.7 “Peak Season” means periods of high demand as determined by us and communicated at the time of booking.
2. BOOKING AND PAYMENT
2.1 All bookings are subject to availability and must be confirmed in writing by us.
2.2 A booking is only confirmed upon receipt of our Booking Confirmation and payment of the required deposit or full payment.
2.3 The Property is available for booking through our private website and authorised third-party platforms.
2.4 Payment may be made by credit/debit card, as specified at the time of booking.
2.5 Full payment is required at least 6 weeks before the Check-in Date. If booking within 6 weeks of arrival, full payment is required immediately.
2.6 All prices are quoted in British Pounds Sterling and include VAT where applicable.
2.7 We reserve the right to cancel any booking if payment is not received by the due date.
2.8 Our booking system is Payment Card Industry Data Security Standard (PCI DSS) compliant, and encryption protected.
3. SECURITY DEPOSIT
3.1 A Security Deposit of £200 is required for all bookings to cover potential damage, breakages, excessive cleaning, lost or non-returned house keys or other breaches of these Terms.
3.2 The Security Deposit is not protected under a Tenancy Deposit Protection scheme as this is a holiday letting operating under a licence to occupy, not an assured short-hold tenancy.
3.3 The Security Deposit will be collected as a pre-authorisation hold on your payment card at the time of booking confirmation. This hold reserves the funds without charging your account and will remain in place until released following your departure.
3.4 The Security Deposit pre-authorisation hold will be released within 7 days of Check-out, provided no deductions are required. The release timeframe may vary depending on your card issuer’s processing times.
3.5 We may retain all or part of the Security Deposit to cover: (a) damage to the Property or its contents; (b) missing items; (c) excessive cleaning requirements; (d) breach of house rules; (e) additional costs incurred due to Guest actions.
3.6 Any deductions will be itemised and supported by evidence (receipts, photographs, etc.) and communicated to you within 7 days of Check-out.
3.7 If damage exceeds the Security Deposit amount, you remain liable for the additional costs.
4. CANCELLATION AND REFUNDS
4.1 There is no statutory 14-day cooling-off period for holiday accommodation bookings. Cancellation rights are governed by these Terms.
4.2 Cancellations made 6 weeks or more before the Check-in Date: Full refund minus booking confirmation fee and £75 administration fee.
4.3 Cancellations made less than 6 weeks before the Check-in Date: No refund (100% charge applies).
4.4 All cancellations must be notified in writing to contact@bellcottageyorkshire.co.uk
4.5 The £75 administration fee applies to all cancellations regardless of timing or reason.
4.6 In exceptional circumstances beyond our control (force majeure events, government restrictions preventing travel), we will work with you to reschedule or provide appropriate refunds in accordance with consumer protection law.
4.7 We reserve the right to cancel bookings due to circumstances beyond our control. In such cases, we will provide a full refund or offer alternative dates.
4.8 Cancellation insurance is recommended and available through third-party providers.
5. CHECK-IN AND CHECK-OUT
5.1 Standard Check-in time: 4:00 PM on the Check-in Date.
5.2 Standard Check-out time: 10:00 AM on the Check-out Date.
5.3 Alternative Check-in/Check-out times may be arranged by prior agreement with us.
5.4 Check-in instructions and key collection details will be provided prior to arrival.
5.5 You must not arrive before the Check-in time or remain after the Check-out time without prior arrangement.
5.6 Upon Check-out, you must: (a) place all used linen in the bathroom; (b) empty all bins; (c) wash all used utensils and leave them clean and dry; (d) replenish any consumables used (tea, coffee, toilet paper, etc.); (e) secure all doors and windows; (f) return keys as instructed.
5.7 Failure to complete Check-out requirements may result in additional charges deducted from the Security Deposit.
6. OCCUPANCY AND GUEST RESPONSIBILITIES
6.1 Maximum occupancy: 4 guests. This limit must not be exceeded without prior written consent.
6.2 Minimum stay: 2 nights. However, bookings of less than 3 nights will be charged for 3 nights minimum.
6.3 The Property is let for holiday purposes only. Commercial use is prohibited.
6.4 You must treat the Property and its contents with care and respect.
6.5 You are responsible for the conduct of all members of your party and any visitors.
6.6 Smoking is prohibited inside the Property. Any evidence of smoking will result in forfeiture of the Security Deposit and additional cleaning charges.
6.7 Parties, events, or gatherings are not permitted without prior written consent.
6.8 Noise levels must be kept reasonable, particularly between 10:00 PM and 8:00 AM, out of respect for neighbors.
6.9 You must comply with all local laws and regulations during your stay.
6.10 Any damage, breakages, or losses must be reported to us immediately.
7. PETS
7.1 The Property is pet-friendly. Well-behaved pets are welcome by prior arrangement.
7.2 An additional cleaning fee of £20 applies to all bookings with pets.
7.3 You must declare all pets at the time of booking.
7.4 You are responsible for your pet’s behavior and any damage caused.
7.5 Pets must be kept under control at all times and not left unattended in the Property.
7.6 Pet waste must be cleaned up immediately, both inside and outside the Property.
7.7 Pets are not permitted on furniture or beds unless specifically agreed.
7.8 Additional charges may apply for excessive pet hair, damage, or cleaning requirements.
8. WIFI AND PARKING
8.1 Complimentary WiFi is provided for your convenience.
8.2 We do not guarantee continuous internet connectivity and are not liable for any disruption to service.
8.3 WiFi usage must comply with acceptable use policies and applicable laws.
8.4 On-street parking is available free of charge, subject to local parking regulations.
8.5 We do not guarantee parking availability and are not responsible for parking fines or vehicle damage.
8.6 You must comply with all local parking restrictions and regulations.
9. LIABILITY AND INSURANCE
9.1 Under the Occupiers’ Liability Act 1957, we maintain the Property in a safe condition for holiday letting purposes.
9.2 You occupy the Property at your own risk. We are not liable for any personal injury, loss, or damage except where caused by our negligence.
9.3 We strongly recommend that you obtain comprehensive travel insurance covering personal belongings, cancellation, and public liability.
9.4 We are not responsible for loss or damage to personal belongings left in the Property.
9.5 You are liable for any damage caused by your negligence or that of your party or visitors.
9.6 Our liability is limited to the total amount paid for your booking, except in cases of death or personal injury caused by our negligence.
9.7 We are not liable for any indirect, consequential, or special damages.
10. PRICING AND SEASONAL VARIATIONS
10.1 Prices vary according to season, demand, and local events.
10.2 All prices are confirmed at the time of booking and stated in the Booking Confirmation.
10.3 Peak Season rates apply during periods of high demand, including but not limited to school holidays, bank holidays, and local festivals.
10.4 Prices include standard utilities (gas, electricity, water) for normal domestic use.
10.5 Excessive utility usage may result in additional charges.
10.6 All prices are subject to change until a booking is confirmed.
10.7 Special offers and discounts may be available and will be clearly stated at the time of booking.
11. DATA PROTECTION
11.1 We process your personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
11.2 Personal data is collected for the purposes of processing your booking, providing our services, and complying with legal obligations.
11.3 We may share necessary information with third-party service providers (cleaning services, maintenance contractors) to fulfill our obligations.
11.4 Your data will be retained for as long as necessary for the purposes outlined above and in accordance with our legal obligations.
11.5 You have rights under GDPR including access, rectification, erasure, and portability of your personal data.

11.7 We do not sell or rent your personal information to third parties for marketing purposes.
12. FORCE MAJEURE
12.1 Neither party shall be liable for any failure to perform their obligations due to circumstances beyond their reasonable control.
12.2 Force majeure events include but are not limited to: acts of God, natural disasters, war, terrorism, government restrictions, pandemic, epidemic, or other public health emergencies.
12.3 If a force majeure event prevents your stay, we will work with you to reschedule or provide appropriate compensation in accordance with consumer protection law.
12.4 If we are unable to provide the Property due to force majeure, we will provide a full refund.
12.5 Government travel restrictions or lockdowns that prevent your stay will entitle you to a full refund in accordance with Competition and Markets Authority guidance.
13. COMPLAINTS AND DISPUTES
13.1 We are committed to providing excellent service. Any complaints should be raised with us immediately during your stay or as soon as possible thereafter.

13.3 We will investigate all complaints promptly and work to resolve issues fairly.
13.4 If you are not satisfied with our response, you may seek advice from Citizens Advice (03454 04 05 06) or pursue alternative dispute resolution.
13.5 For disputes that cannot be resolved amicably, the matter may be referred to the appropriate court in England and Wales.
14. GOVERNING LAW AND JURISDICTION
14.1 These Terms are governed by the laws of England and Wales.
14.2 Any disputes arising from these Terms or your stay shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14.3 Consumer rights under the Consumer Rights Act 2015 and other applicable consumer protection legislation remain unaffected by these Terms.
14.4 If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15. VARIATION AND SEVERABILITY
15.1 We may update these Terms from time to time. The version in effect at the time of your booking shall apply to your stay.
15.2 Any variations to these Terms must be agreed in writing.
15.3 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15.4 The invalidity of any provision shall not affect the validity of the remaining Terms.
16. ENTIRE AGREEMENT
16.1 These Terms, together with your Booking Confirmation, constitute the entire agreement between you and us.
16.2 These Terms supersede all prior negotiations, representations, or agreements relating to the subject matter.
16.3 No oral modifications to these Terms shall be binding.
16.4 By making a booking, you acknowledge that you have read, understood, and agree to be bound by these Terms.
